Terms of Service

These Terms of Service govern your use of the Hosi360 platform operated by Makhety Digital Solutions ("Makhety", "we", "us"). By activating a Hosi360 subscription, you agree to these terms.

1. The Service

Hosi360 is a web-based clinic and hospital management system provided on a subscription basis. We grant you a non-exclusive, non-transferable licence to access and use Hosi360 during your active subscription period for the purpose of managing your healthcare facility.

2. Your account

• You are responsible for all activity under your account.
• You must keep your login credentials confidential.
• You must notify us immediately if you suspect unauthorised access.
• Each subscription covers one facility. Additional facilities require separate subscriptions.

3. Subscriptions and payment

• Subscriptions are available on monthly, annual, or lifetime terms as described on the pricing page.
• Payment is due in advance. Access is suspended if payment is not received within the grace period (7 days after expiry).
• All prices are in Kenyan Shillings (KES) and are inclusive of applicable taxes.
• We do not offer refunds for unused subscription periods, except where required by Kenyan law.
• We reserve the right to adjust pricing with 30 days' written notice to active subscribers.

4. Acceptable use

You agree not to:

• Use Hosi360 for any unlawful purpose or in violation of any Kenyan law or regulation
• Share your login credentials with users at other facilities
• Attempt to reverse-engineer, copy, or resell the Hosi360 software
• Upload or store data that you do not have the right to process
• Interfere with the security or integrity of the platform

5. Your data

You own the data you enter into Hosi360. We process it on your behalf in accordance with our Privacy Policy. You may request a full export of your data at any time. We will provide it within 7 business days.

6. Data responsibility

As a healthcare facility, you are responsible for ensuring that patient data entered into Hosi360 is handled in compliance with applicable Kenyan health data regulations, including the Kenya Health Act and any applicable data protection laws. Makhety provides the platform and security infrastructure; clinical responsibility remains with your facility.

7. Uptime and availability

We target 99% monthly uptime. Planned maintenance is communicated at least 24 hours in advance. We are not liable for downtime caused by third-party infrastructure, acts of God, or events outside our reasonable control.

8. Suspension and termination

• We may suspend access for non-payment, breach of these terms, or activity that endangers the platform or other users.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• On termination, your data is retained for 12 months, after which it is deleted. You may request deletion earlier.

9. Limitation of liability

To the maximum extent permitted by Kenyan law, Makhety's liability for any claim arising from use of Hosi360 is limited to the amount you paid in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Governing law

These terms are governed by the laws of Kenya. Disputes shall be resolved in the courts of Kenya.

11. Changes to these terms

We will notify you by email at least 14 days before making material changes to these terms. Continued use after the effective date constitutes acceptance.
